Are they saying that transporting a plant across the country is not a bio hazard if it is free.

Yes. Daft isn't it.....

There are many other "what ifs...." that could be documented.

If I post a plant to my next door neighbour it supposedly needs a passport. If I hand it over the garden wall it doesn't.

At the end of the day like Ralph and myself have said (in this and the other thread) the legislation only applies to PROFESSIONAL OPERATORS. The powers that be have been asked about this and they have not replied to the contrary.

Look at it this way - I bet there are only about a dozen inspectors for the whole country. How long is it going to take them to check the big supermarkets/garden centres/distribution centres. They are not going to even look at a residential house.

I'm not a subscriber to Horticultural Week so can't see the full article, but this may be of interest

"Plant passports not required for garden show commercial sales
19 February 2020, by Matthew Appleby

Ahead of the garden show season, traders need to know they don't need plant passports on plants they are selling direct to the public."

Googling the article adds this

"Plant passports not required for garden show commercial sales. Defra has confirmed growers do not need plant passports when selling face to face at garden shows if a grower-retailer is selling to final users - those buying for personal use, for instance home gardeners."

This seems a clear enough message, trader/professional/amateur or whatever. I guess we knew that already, despite what APHA may have said.

Is the society planning on informing its members about the new legislation?
There are still quite a lot of people who think that plant passports are only for exports.

There was an article about it in last December's ENews: https://us13.campaign-archive.com/?u=6 ... 9587a562c The situation as it applies to nurseries is fairly clear, but the grey area, which even the enforcement agency APHA does not seem to have properly considered, is how it applies to a small number of sales made by amateurs to cover the cost of their hobby. They have used the terms professional and distance selling without properly defining them.

The aspect of the new regulations that many growers are not yet appreciating is that seeds coming from outside the EU could be impounded by Border Force if they do not have Phytosanitary Certificates.
